Privacy policy

Purpose

Mogo is committed to protect the privacy of personal information which it handles. This privacy policy recognizes the rights of individuals applying for positions at Mogo (“Candidate” or “Candidates”) to keep their personal information private in accordance with applicable state and territory privacy legislation.

 

Mogo

For the purposes of this policy, unless expressly stated otherwise, references to Mogo are references to all together or each individually:

Mogo Auto LTD, legal address: Pinetree Plaza, Kaburu Drive off, Ngong Road, Nairobi, Kenya.

 

Mogo Group

For the purposes of this policy, unless expressly stated otherwise, references to Mogo Group are references to Mogo Finance S.A., a Grand-Duchy of Luxembourg based company incorporated as a public company limited by shares (société anonyme) under the laws of Luxembourg, having its registered address at 9, Allée Scheffer, L-2520 Luxembourg, and registered with the Luxembourg Trade and Companies Register under number B174457 and all Mogo Finance S.A. directly or indirectly controlled legal persons (subsidiaries).

 

Collection of personal information

As part of its recruitment process, Mogo may collect:

personal information, which is received from Candidates, including information received through any application tools that the Candidate uses;

education and work related information which Candidate has posted on social networks.

Collectively, your personal information is referred to as “Your Information”. Mogo during recruitment process asks Candidates to submit information which is directly relevant to the recruitment process. Respectively we ask you not to submit irrelevant information (health, marital status, political believes or any other sensitive information). Unless required by law, Mogo will not require you to provide any health information or sensitive information.

Mogo will obtain your consent prior to contacting third parties, such as referees, for references or further information.

 

How Mogo uses Your Information

Your Information will be used by Mogo to enable Mogo to consider you for employment and to facilitate the recruitment process. Mogo may also use Your Information for statistical purposes, but only as anonymized data.

All data will be stored and processed by Mogo authorized persons in order to facilitate the recruitment process. Your Information will be used for recruitment purposes, including, but not limited to background and reference checks; evaluation for job suitability, eligibility or qualifications; recruitment or hire; verification of data and check information provided.

Mogo will not disclose Your Information to other third parties, except for:

Service providers

In order to fulfill Mogo obligations towards Candidate, Mogo disclose Your Information to companies that provide Mogo with services, such as selection and HR companies. These companies may process Your Information only in accordance with instructions of Mogo and may not be used for any other purpose. These companies are required by law and cooperation agreement to protect Your Information.


Mogo Group Companies

Mogo may disclose Your Information to the respective companies of the Mogo Group, if your application or practice is linked to other Mogo Group companies.

Law enforcement agencies, state and local government institutions

In order to fulfill Mogo legal obligation, Mogo may disclose Your Information to law enforcement authorities, state and local government authorities at their request. Mogo can also transfer Your Information to law enforcement agencies, state and local government bodies in order to defend Mogo legal interests – to bring an action in court, implement or defend legal requirements.

Mogo will not use Your Information for any other purpose (other than those detailed above) unless Mogo has obtained your prior consent, or as required or authorised by law.

 

Access and correction

Controller guarantees that Candidate has all the statutory rights regarding his/her data submitted, including the rights to access personal data, ask to delete his/her data or transfer data (data portability), make amendments and corrections at any time by contacting [email protected] and Mogo will make all reasonable and practical efforts to comply with request.

Candidate has rights to withdraw consent at any time by contacting [email protected] without affecting the lawfulness of processing based on consent before its withdrawal.

 

Security and storage

Mogo will take reasonable steps to ensure that Your Information is protected from misuse, loss, unauthorised access, modification and disclosure.

Your Information will be stored in Microsoft 365 cloud service, which provides security, confidentiality and data storage within the European region, including system backup.

If you are not successful in your application, but have clearly indicated that you may be interested in other positions at Mogo, then Mogo will retain part or all of Your Information (such as your resume) on file for a limited period of 2 years. After that period Mogo will erase or anonymize your data and use it only for statistical purposes.

If you have clearly indicated, that you are not interested in other positions at Mogo, Your Information will be anonymized or erased 3 months after end of recruitment project.

This policy represents Mogo recruitment privacy policy as of 25 May 2018. Mogo may change this policy from time to time. Mogo may act outside the policy if any legal obligations arise to you or under any law.
